City of Lancaster Blessed with Second Victory in Prayer Case
United States Court of Appeal Judges Affirm District Court Ruling Upholding the City’s Invocation Policy
The United States Court of Appeals for the Ninth Circuit has ruled in favor of the City of Lancaster in the case of Shelley Rubin and Maureen I. Feller v. City of Lancaster, a case in which U.S. District Judge Dale Fischer originally concluded in favor of the Defendant (the City of Lancaster) on July 11, 2011. Unhappy with the outcome, the Plaintiffs appealed the decision and were determined to once again challenge the City’s Invocation Policy, as well as the reference to Jesus Christ in the invocation which opened the April 27, 2010 Lancaster City Council meeting.
A panel of three judges, including District Judge Jack Zouhary, as well as Circuit Judges Alfred T. Goodwin and Diarmuid F. O’Scannlain, affirmed the District Court’s bench trial judgment in favor of the City of Lancaster. The judges found that the single reference to Jesus in the invocation by Bishop Henry Hearns did not violate the Establishment Clause, as it was not utilized as an attack or promotion of any one religion or government with a particular faith.
Furthermore, the plaintiffs’ contention regarding the Lancaster City Council having an unwritten Christian bias was rejected by the panel. Neither the City record nor City prayer policy indicates a specific affiliation with Christianity, and the choosing of prayer content and denomination does not fall on the Council, but instead derives from local demographics as well as the voluntary participation of religious leaders.
“Sometimes lessons learned require more than one teaching,” said City of Lancaster Mayor R. Rex Parris. “The City of Lancaster is overjoyed to once again be vindicated of these erroneous charges. The act of group prayer is supposed to be a practice which draws people together into a state of humility and oneness, not of hostility and separatism. This is why all denominations are welcome to participate and lead in our City Council Meeting invocations.”
During its August 25, 2009 regular meeting, the Lancaster City Council approved and adopted its Policy Regarding Invocations at Meetings of the City Council of the City of Lancaster. Pursuant to this Invocation Policy, the Lancaster City Clerk compiles and maintains a database of religious congregations with an established presence in the city. The City Clerk does not inquire into the faith, denomination, or other religious belief of a congregation included on the list, or that asks to be included on the list.
On November 10, 2009, the City Council further decided to submit to City voters a ballot measure (Measure “I”) which asked: “In response to a recent complaint, with respect to the invocations that contained reference to Jesus Christ, shall the City Council continue its invocation policy in randomly selecting local clergy of different faiths to deliver the invocation without restricting the content based on their beliefs, including references to Jesus Christ?”
During the April 13, 2010 general municipal election, Measure I passed by a more than 3-1 margin; with 9,765 votes in favor and 3,116 votes in opposition.

The following observations, colored my personal development in my Career for over 4 decades, and were initially gleaned through my employment with Los Angeles Superior Court Judge, Earl C. Broady, Sr....Los Angeles Superior Court Judge, Charles R. Scarlett...and Los Angeles Superior Court Judge, Robert L. Roberson, Jr., [now with ARC]...of the Law Firm of Broady, Scarlett & Roberson...before these Legal Giants took the Bench. The young Lawyers they mentored, included the late Attorney Johnnie L. Cochran, Jr...and Tehachapi, CA's, Criminal Defense Attorney, Harry M. Reynolds.

At one point, Broady, Scarlett & Roberson domimated the criminal law practice in southwest Los Angeles, until Johnnie Cochran came along with the Deadwyler Case, and the Firm moved into the additional practice areas of Personal Injury, Family Law, Probate, Unlawful Detainer, as well as the ongoing criminal trial practice. The Successor Law Firm, Ivie McNeill & Wyatt, is located in Bunker Hills of Downtown Los Angeles. Many of the current clients of the Successor Law Firm, are the grown issues of former clients of the Predecessor Law Firm. To that extent, the Law Firm of Broady, Scarlett & Roberson has lived on in perpetuity. The success of Broady, Scarlett & Roberson was not by accident. It was programed into the fabric of the law practice, the principles were unswerving, and applied to everyone in the office.

By the way, Judge Broady mentored Attorney Johnnie L. Cochran, Jr., and Attorney Harry M. Reynolds, in the Core Competencies of Lawyers and how to structure a productive law practice. Johnnie’s almost daily presence in the Broady law office after hours, was legendary. Decades later one can glean that mentoring paid off; because the Cochran Firm (started in 1967), as well as Judge Broady’s firm (started in 1948) are still thriving successor law practices years after their death. Attorney Harry Reynolds left his footprint in Century City, CA before relocating his practice to Kern County. The systemic productivity was etched into the fabric of the Firm's law-office-practices and became standard-operating procedures...everyone knew.

ON A SIDE NOTE: I’ll bet retired Orange County Superior Court Judge, Martin Engquist, has some stories to tell about Judge Broady. (I met Judge Engquist when I taught in InterCoast College’s Orange County Paralegal Program for 10 years, and would take my students to the Courthouse twice a month, to glean in real time, how the results of the Students’ knowledge of Substantive-Law and Law-Office-Procedural-Practice Skills (in producing Court-compliant documents and pleadings,) would play out in the Courtroom. It was a true, learning moment when students would hear Lawyers make reference to a particular pleading that the Students had prepared in Class, or the document had been referenced in class lectures.

Those listening moments in the Courtroom helped to seal Students’ working knowledge of the profession, to this very day. Any Student – will rise to the level to which the Teacher takes them. Do other Teachers take their Students to the Courthouse? Some do and some don’t, but should. How then did I know to take my Students to the Courthouse? It’s not written in any of The Standards of teaching, to take Paralegal students to the Courthouse. I did so because I have plenty of “Horse-Sense” and it logically followed that Students educational career would be enhanced, and etched indelibly into their psyche, from the process. Hence, I say to Students: Go to the Courthouse and observe Courtroom proceedings, even if you are a “force of one”. It's not in preparation to become a Lawyer. It's in preparation of becoming more functional in the law office...before...you leave school and transition into the law office. Lawyers don't have the time nor the resources to teach you. Hence, why in most instances, Lawyers want Paralgals with 3-5 years prior work experience; because there's a Lawyer's sobering conclusion that hands-on-applications in law-office-practice-skills are not being taught in paralegal schools, specifically.

I had occasion to meet Judge Engquist when my Class observed his Courtroom proceedings while I was teaching the Criminal Law Module. (Judge Engquist’s mustache, styled like a bicycle-handle-bar, is still unforgettable.) Judge Engquist was impressed that Teacher and Students were interested enough in the Court’s process to make it a standard operating proceeding to observe courtroom proceedings.

On one occasion, Judge Engquist invited my Class into his Courtroom Chambers during a recess, where Students fielded prepared questions to him. That too was an unforgettable moment for Paralegal Students. At some point, Judge Engquist asked me about my academic training and work history, and I mentioned the name Los Angeles Superior Court Judge, Earl C. Broady, as part of my work history.

That is when Judge Engquist proceeded to tell me that he and Judge Broady were Law Enforcement Officers in the Los Angeles Police Department together; that when Judge Broady became a Lawyer, he decided to become a Lawyer; and that when Judge Broady decided to take the Bench, he later decided to take the Bench.
.
Observing Judge Engquist’s court proceedings became a routine for the Students, who would also attend court proceedings after school was out. Student grew to love the law; and their heightened attention to the coursework and later career successes have proven that such was the case, as a result of their employment with such law offices as Sheppard-Mullin; Manatt-Phelps; Gibson, Dunn & Crutcher; Hulsey & Hulsey; Malek & Malek; Keller Williams Real Estate; Wright, Finlay & Zak; Law Offices of Wilma Presley; Mayer-Brown; Palumbo Bergstrom; Deloitte
& Touche; Olaf Landsgaard, Esq.; Wells Fargo
Bank; William Kropach, Esq.; the Colorado State Attorney General’s Office and the Hawaii State Attorney General’s Office.

MAJOR PREMISE:
THE ATTORNEY’S CORE COMPETENCIES
.
Judge Broady’s Major Premise (and I’ve euphemistically dubbed “The Broady Principle”) was stated as follows (and I paraphrase):
“ If an Attorney does three (3) things Daily, and 3 things only, then he or she has done a good day’s work. Those three Core Competencies are:
(1) going to Court;
(2) returning from Court and discussing case strategies with the clients; and
(3) collecting money.

Everything else -- is left to competent people within the Law Office.”
.
Competency and quality control was assured by the foregoing criteria that affected all levels of divisions of labor within the firm.

MINOR PREMISE:
A PARALEGAL IS EVERYTHING MINUS 3.
.
A Paralegal is “Everything Minus 3". It is minus the 3 Attorney Core Competencies. The [Broady Principle], therefore, defined the divisions of labor in a law office. Legal Staff were cross-trained and knew the file clerk's functionality up to the highest level of functionality in their own positions.
.
The role of a Paralegal is to free up Attorneys' time so Attorneys can concentrate on their "Core Competencies". Paralegals (1) do not go to court; (2) Paralegals do not discuss case strategies with clients (but Paralegals do interview clients and handle client-intake memoranda); and (3) Paralegals do not collect money (unless directed by the Lawyer). These Core Competencies remain in the exclusive domain of Lawyers. To the extent that Paralegals and other staff support, free up Attorneys' time to address their Core Competencies, then the Lawyer and Paralegal have done a good day’s work. The level of Paralegal’s continued personal development of all other endeavors, minus 3, defines the Paralegal's added-value to the Firm, the Firm's profits, the Paralegal’s earnings, and the Paralegal's longevity.
. CONCLUSION:
SUCCESS OF THE LAWYER, THE PARALEGAL AND LAW FIRM ARE FOREGONE CONCLUSIONS WITH APPLICATION OF THE BROADY PRINCIPLE.

If Paralegals assist Lawyers to the extent that Lawyers can begin focusing on their 3 Core Competencies only, we satisfy then, the requirements of the Major Premise. Herein lies the successful functionality of The Broady Principle, and law firm success has always been a foregone conclusion.

The Divisions of Labor, under The Broady Principle, are clearly defined for both Lawyer and Support Staff. Hence, a Paralegal knows that he or she is, “Everything minus 3” and undoubtedly knows what tasks to assume, or study for the undertaking, in the law office. It doesn’t matter what area of law is practiced, nor whether you stay or go to another law firm or a business unrelated to law, altogether. You should see to it that your working knowledge grows exponentially with the law firm’s success, that now includes a working knowledge of e-Discovery.

Note: Ground yourself in a thorough working knowledge of civil litigation and "Discovery" first, and the appreciation of e-Discovery will be almost seamless, in that e-Discovery has its genesis in the basic principles of Discovery. Instead of discovering evidence in paper-form, it is discovering evidence in electronic form and understanding the retrieval process. It's analogous to students learning how to conduct legal research. You should [Not] have been taught Westlaw and Lexis Nexis...first. You should have been taught how to [manually conduct] legal research...first. What if all the computers crashed in the office and a lawyer needed to determine whether a case was still good law? Yes, they still publish Sheppard Citators in print. Hence, when students were then transitioned to Westlaw and Lexis Nexis, comprehending the computerized version of legal research was seamless, because the computerized version an overlay of manual legal research. Got it?!

It's also why some students cannot add, subtract, divide nor multiply without a calculator. Personally, my Son didn't see a calculator until he was able to add, subtract, divide and multiply. I'll say it again, that Technology will Not replace...The Thinkers. It will replace...The Button-Pushers.

Paralegals now know, undoubtedly, what their Division of Labor is--Everything Minus 3. .

What's even more huge. . . is the manner in which Apple's [discovery failure] was made manifest. It had to be one of Plaintiff's Counsel's finest hours. Bravo!

judgment motion] were exhibits that had not been turned over to Counsel for Plaintiff, iPhone, [Audet & Partners LLP] during the lengthy discovery process. The Judge [with jaundice eye] ordered that Apple could not entertain its motion again until it had evidenced to the court that it had complied with Discovery. That had to be one

Complex litigation is often so contentious that the word
"admission" seems like a waste of time. Notwithstanding the
language in Rule 36(b) providing that "[a] matter admitted under this rule is conclusively established unless the court, on motion, permits the admission to be withdrawn or amended[,]" requests for admission are used far less than other discovery devices.
Perhaps this is because unlike interrogatories and requests for production and depositions, requests for admission are much more useful after you've conducted other discovery. When you ask the other party to admit or deny something, you are not "discovering" information so much as confirming a fact or obtaining a concession.
How many of you enjoy long trials? Yes, I thought so. What about briefing summary judgment motions when you know the other party can't counter certain points, but you have to brief them anyway?
The most obvious use of requests for admission is to simplify your case (and shorten your trial or eliminate a needless summary judgment motion) by establishing proof of issues or elements of your claims that the opposing party cannot challenge at trial.
For example, the first element of a breach of contract claim is that there is, in fact, a contract. If the litigation to date has focused on whether a breach occurred, why not get an admission that a contract exists? If the opposing party will not admit the existence of a contract, you could also use a request for admission to establish a sub-element of your claim -- i.e. ask them to admit that on Date X, the party received the offer. You can then focus your energies at trial or in summary judgment briefing on the disputed aspects of the claim.
2. PINNING DOWN SLIPPERY INTERROGATORY ANSWERS
Has an opposing party ever answered an interrogatory after a long paragraph of objections? And include a list of "general objections" in the preamble to their answers? The interrogatory answer usually begins: "Subject to the above objections ...."
To winnow or even eliminate these boilerplate objections, carve out the part of the interrogatory answer you'd like to use in your summary judgment motion or at trial, and turn that statement into a request for admission. Since the other party included the statement in its (qualified) response, it should not be able to deny the statement.
3. AUTHENTICATION MADE EASY
Authenticating exhibits at trial can be a drag. Federal Rule of Evidence 902 lists certain types of evidence that are self-authenticating such as certified copies of public records and newspapers. http://www.law.cornell.edu/rules/fre/rule_902
Other exhibits -- the vast majority -- require either evidence or testimony for authentication, as set forth in Federal Rule of Evidence 901 -- unless the opposing party stipulates to their authenticity. http://www.law.cornell.edu/rules/fre/rule_901
Thus, you can use requests for admission to authenticate documents, obviating the need to go through the arduous process of authentication at trial. Rule 36(a)(1) provides that a request for admission may ask a party to admit "the genuineness of any described documents." Obviously, to make sure that both parties are talking about the same document, you should attach a copy and/or refer to the document by Bates number.
If you have many documents to authenticate, consider a request for admission that refers to an attached exhibit listing the documents by Bates number. You can also attach as an exhibit a disk or flash drive containing electronic copies of the documents (which should also be Bates numbered). The accompanying request for admission would ask the party to admit that (1) the copy (or electronic version) of each document identified by Bates number in Exhibit A is a true, correct, and genuine copy.
These examples demonstrate how you can use requests for admission -- the discovery tool that isn't really a discovery tool. Once you start using it, you'll probably find other ways to streamline the litigation process, which should please your clients.
